For some of us who would be ready to travel to Sweden for higher qualifications, it is necessary that you get yourself with the rules on working in Sweden to make more money to keep body and soul together.
Nordic citizens, EU/EEA citizens, Swiss citizens and the family members of these groups, as well as people with long-term resident status in another EU country are not required to apply for a work permit.
People who will be working in Sweden for only short periods in certain occupational categories are also exempt from the work permit requirement.
Who needs a work permit?
Other foreign citizens who want to work in Sweden must have a work permit. It does not matter whether they are employed in Sweden or abroad. This means posted workers and employees transferred within a corporation to work or do work experience/internship must have a work permit.
The requirement also applies to short-term transfers for internal training and skills enhancement on company premises.
Self-employed persons do not need a work permit, but must have a residence permit.
When is a residence permit required?
People who will be working in Sweden for more than three months also need a residence permit. Citizens of certain countries who will be working in Sweden for less than three months must have a visa. For information about which nationalities are covered by this rule, see www.ud.se.
What is required to get a work permit?
A person who wants to work in Sweden must have an Offer of Employment from an employer or client in Sweden.
The following are also required to be granted a permit:
* The job must have been advertised in Sweden and the EU for ten days (applies to new recruitments).
* The terms of employment must be equal to or better than those provided under a Swedish collective agreement or that customary for the occupation or industry, and the employee must earn enough from employment to support himself/herself.
* The scope of the work is such that the monthly wage is at least SEK 13,000 before tax.
* The relevant trade union has been given the opportunity to express an opinion on the terms and conditions of employment.
* The employee has a valid passport.
Where should the employee apply for a residence and work permit?
The main rule is that the employee must apply for a residence and work permit in the country of origin or another country outside Sweden in which he/she resides. The permit must have been granted and affixed to the passport before entering Sweden. In certain exceptional cases, employees may apply for a work permit while in Sweden.
People who may apply in Sweden:
* Students who want a residence permit to work, rather than study. Students must have completed at least 30 ECTS credits or one semester/term of postgraduate education in Sweden.
* Job applicants who are in Sweden to visit an employer and have been given an offer of employment. There must be a special need to begin work immediately and high demand for labour in the occupation. Occupations for which there is high demand are found on a special list posted on the Migration Board website.
* Asylum-seekers whose application for asylum has been denied and the decision has taken legal force.
The conditions for being granted a work permit must also be met.
What applies to family members?
Family members of employees may be granted a residence permit for the same duration as the residence and work permit granted to the employee. If the permit is valid for at least six months, family members may also be granted a work permit.
The following people are considered family members:
* Husband/wife, de facto (“common law”) spouse or registered domestic partner
* Children (under the age of 21) of the employee or his or her husband, wife, de facto spouse or registered partner.
Children over the age of 21 cannot be granted a residence permit unless they are financially dependent upon the parent.
Note that the age limit for work permits is 18 for family members of asylum-seekers who are granted a residence and work permit. In addition, if they are in Sweden and have applied for asylum, their decision must have taken legal force and the application must have been submitted within two weeks of the date the decision took legal force.
How much does it cost?
Most applicants must pay an application fee. The fee is SEK 2,000 [$285.00] for a first-time application for a work permit and for certain applications to extend a permit.
However, the fee is SEK 1,000 when the application to extend a permit applies to the same employer or occupation.
The fee is SEK 1,000 for family members over 18 and SEK 500 for family members under 18.
How long is the permit valid?
If the employment is temporary, the employee will be granted a residence and work permit valid only for that period, but for a maximum of two years at a time.
After 48 months, the employee will be eligible for a permanent residence permit.
What happens if the employee changes employers?
For the first two years, the residence and work permit is restricted to a specific occupation and a named employer. For that reason, the employee must apply for a new work permit if he/she changes employers or occupations during the first two years.
If the residence and work permit is extended after two years, it is restricted only to a specific occupation. If the employee changes occupations, he/she must apply for a new work permit.
What happens if employment is terminated?
A residence and work permit in Sweden is always temporary.
If the employee loses his/her job, the Migration Board may withdraw the residence permit. However, the employee may look for other employment in Sweden for three months after the date the previous employment ended.
If the employee does not find a new job during that period, the Migration Board may withdraw the residence permit and the employee must leave the country.
If the employee gets a new job and the current permit does not cover the new employment, he/she must submit a new application for a work permit. The Migration Board will then examine the prerequisites for employment by the new employer.
Putting and Appeal
Decisions to reject an application for a work permit cannot be appealed.
